This Cloud4Them Terms of Service (this “Agreement”) governs your purchase and use of all “Cloud4Them” services (collectively, the “Services”), as described in the Order Form(s) submitted by you and accepted by “Cloud4Them” (“Service Order”). You must register and accept the terms of this Agreement to use the Services. BY CLICKING ON THE “I ACCEPT” BUTTON BELOW, AND/OR REGISTERING FOR AND USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, AND AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS OF THIS AGREEMENT AS WELL AS ALL POLICIES, WHICH ARE INCORPORATED HEREIN BY REFERENCE. “Cloud4Them” may modify any of the terms and conditions contained in this Agreement and the AUP, at any time, in its sole discretion. Any modifications are effective upon posting of the revisions on the “Cloud4Them ” website (the “Site”). Your continued use of the Services following “Cloud4Them” posting of any modifications constitutes your acceptance of the modifications. If you do not agree to the terms of any modification, do not continue to use the services and immediately notify “Cloud4Them” of your termination of this Agreement in the manner described in the section below.

1. Content

We do not tolerate the expression of hate speech or terrorism on our network. If we receive notice of any hosted content that violates these guidelines, the hosting client will be immediately notified and is obligated to remove the content within a specified period, or face the suspension and/or termination of the account, with no refund provided.

We encourage clients to self-regulate the content of their accounts and take responsibility for the public offerings of their site. Furthermore, if another user gains access to your account, you are responsible for their actions.

1.1. Illegal Use

Cloud4Them’s servers may only be used for legal purposes. The storage or publication of any information, data, or material that violates any regulation or law is strictly prohibited. This includes, but is not limited to, copyright infringement, trademark violations, unauthorized use of intellectual property, sale of restricted pharmaceuticals, and material that is obscene and/or defamatory, or constitutes illegal activity. Examples of unacceptable content include pirated software, hacker programs or files, warez sites, mp3, and IRC bots.

By subscribing to Cloud4Thems services, you agree to indemnify and hold Cloud4Them harmless from any claims arising from the use of the services that may cause harm to the subscriber or a third party in accordance with Colombian laws.

Cloud4Them cannot serve as a platform for the distribution of illegal content. Therefore, storing illegal content on Cloud4Them’s servers is strictly prohibited, and linking to other sites with illegal content is equally restricted. Cloud4Them will be the sole arbiter in determining what constitutes a violation.

1.2. Prohibitions

  • Child Pornography: Under no circumstances will content related to child pornography, in any form, be allowed. In the event that Cloud4Them becomes aware of such content on its network, the site will be immediately terminated, without prior notice or refund.
  • Security Violations: System or network security violations are prohibited and may result in criminal and civil liability. Examples include, but are not limited to, unauthorized access, use, testing, or probing of security measures or authentication systems, data or traffic. Interfering with service to any user, host, or network, including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, and broadcast attacks. Falsification of any TCP-IP packet header or any part of the header information in an email or news group.
  • Server Resource Abuse: Due to resource usage policies, any hosting account that uses more than the allocated server resources (e.g., CPU, memory, or network resources) may need to upgrade to a VPS/Dedicated Server to continue consumption at legitimate levels. Failure to migrate to an independent service may necessitate a reduction in resource usage to an acceptable level, as determined solely by Cloud4Them
  • Chat Rooms: Cloud4Them does not provide or allow chat rooms on shared hosting environments; this service is only permitted on Dedicated Servers and VPS. Please note that chat rooms have different management requirements than Basic Chat.
  • Hidden Executable Programs: Cloud4Them does not allow the use of Daemons or the execution of programs such as IRC bots, eggdrop, BitchX, XIRCON, and any other program that interferes with the normal operation of the server.
  • IRC: Cloud4Them does not allow IRC servers, IRC bots, or IRC Shells on shared hosting services. To use these programs, it is necessary to contract a dedicated server.
  • Prohibited Scripts: Proxy servers or scripts, torrent trackers, or torrent clients are not allowed to run on shared hosting and Reseller accounts. Additionally, Cloud4Them does not register, install DLL libraries, .EXE programs, or software on our shared servers.
  • Program Distribution: Cloud4Them shared hosting accounts may not be used for the purpose of distributing programs or multimedia products. If you wish to distribute programs and/or files, please contact sales for a special arrangement.
  • Media Files: Media files are defined as any graphics, audio, and video files. Cloud4Them’s hosting accounts may not be used to store an unusually large amount of media files. Any site where the disk space is used primarily for storing media files that exceed 70% of their total usage, either in terms of total size or number of files, will be notified of their excessive media file usage.
  • Domain Hosting: Cloud4Them strictly prohibits hosting domains with free top-level domains (TLDs).

2. Data Security and Backups

2.1. Client Accountability: The client bears full responsibility for the protection of their data. While Cloud4Them provides tools and resources for data backups, it is the client’s absolute duty to routinely back up their data and verify its integrity.

2.2. Stringent Security Protocols: Cloud4Them maintains unequivocal authority to enforce rigorous security policies and procedures to fortify the integrity of our services and network infrastructure. Any attempt to circumvent these policies or compromise system security will lead to immediate and irrevocable termination of services, without any entitlement to a refund.

3. Payment Terms and Renewals

3.1. Billing and Financial Obligations: Clients are mandated to uphold accurate and current payment information on file. Invoices are issued in advance of the service period and must be remitted in a timely manner. Failure to do so will result in the prompt suspension or termination of services.

3.2. Automatic Renewal Protocol: All services offered by Cloud4Them will be automatically renewed unless the client explicitly requests termination prior to the renewal date. Clients are solely responsible for managing their subscriptions and ensuring timely renewals.

4. Termination of Services

4.1. Termination by Client’s Sole Discretion: Clients may, at their own discretion, formally request the termination of their services at any time. Such requests must be submitted in writing through the designated channels.

4.2. Non-Payment and Financial Default: Failure to meet financial obligations for services will result in immediate suspension or termination of the account, with no further notice.

4.3. Breach of Stipulations: Cloud4Them asserts an unwavering right to suspend or terminate services forthwith if clients infringe upon any of the stipulations delineated in this agreement.

4.4 Cancellation for Services Paid in Advance: If a client has contracted services for multiple months and wishes to cancel their service, no refunds will be provided for the remaining months.

5. Limitation of Liability

Cloud4Them expressly disclaims any and all liability for direct, indirect, incidental, consequential, or exemplary damages, including but not limited to, damages for loss of profits, data, or any other intangible losses arising from the use or inability to use the services provided.
